## TERMS OF SERVICE

**Ytinu OÜ — Terms of Service**
Effective Date: September 13, 2025 (updated 22 June 2026)

These Terms govern your access to and use of ytinumoc.com (the "Site") and any purchases made from Ytinu OÜ. By using the Site, you agree to these Terms.

**1. Company & Contact**
Ytinu OÜ (registry code 17332433) is the operator and seller of record for all purchases on the Site.

**2. Eligibility**
You must be at least 16 years old to use the Site and 18 or the age of majority in your jurisdiction to make purchases. You are responsible for maintaining the confidentiality of your account and for all activity under it.

**3. Orders, Pricing & Payment**
All orders are subject to availability and acceptance. We may refuse or cancel an order at our discretion. Prices are shown in the currency displayed on the Site. The total you pay, including any shipping charge, is shown at checkout before you pay. Clothing is shipped Delivered Duty Paid: you will not pay import duties, import taxes or customs clearance fees on delivery, and if a carrier charges you one we will reimburse it. By submitting payment, you confirm you are authorised to use the selected payment method.

**4. Digital Products**
Foundation Passes and Early Access Keys are digital products delivered electronically. All sales of digital products are final — no returns or refunds unless the product was not delivered or is materially defective.

**5. Shipping & Delivery**
Shipping options, costs, and estimated delivery times are presented at checkout. Estimated dates are not guaranteed. Risk of loss passes to you when the order is delivered to you. Clothing orders are shipped Delivered Duty Paid: we pay applicable import duties, import taxes and customs clearance fees for delivery to the countries we ship to.

**6. Returns & Refunds**
Our Refund Policy explains eligibility, timelines, and how to initiate a return. Apparel items must be unworn, unwashed, and in original condition with tags attached. Items marked as final sale are not eligible for return.

**7. Intellectual Property**
All content on the Site — including designs, logos, images, text, and product names — is owned by or licensed to Ytinu OÜ and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.

**8. User Content**
By submitting reviews, images, or other materials, you grant Ytinu OÜ a worldwide, non-exclusive, royalty-free licence to use, reproduce, and display such content for marketing and operational purposes.

**9. Acceptable Use**
You agree not to: misuse the Site (including hacking, scraping, or disrupting services); upload unlawful, harmful, or misleading content; impersonate others or misrepresent your identity.

**10. Disclaimers**
The Site and products are provided "as is" and "as available" without warranties of any kind, except as required by applicable law.

**11. Limitation of Liability**
To the maximum extent permitted by law, Ytinu OÜ will not be liable for indirect, incidental, or consequential damages. Our total liability will not exceed the amount you paid for the relevant order.

**12. Governing Law**
These Terms are governed by the laws of the Republic of Estonia. Estonian courts shall have jurisdiction, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

**13. Changes to These Terms**
We may update these Terms at any time. The updated version will be posted on the Site with a revised Effective Date. Continued use after changes constitutes acceptance.

**14. Founders’ Jacket (conditional reward)**
The founders’ jacket is a conditional founding reward, not part of what the Foundation Pass price pays for. It is made to measure, in one batch, only if all 1,000 Foundation Passes sell. If it is made, measurements are taken when you claim your Pass and, as a personalised good, the jacket is non-cancellable and non-returnable once production has begun, except where faulty or not as described. Holders who bought under earlier terms keep those terms until they agree otherwise in writing.

**15. Apparel & Tier Discounts**
The Ytinu clothing range (tees, hoodies, jumpers, caps) is sold separately to the public in limited waves. A Foundation Pass's sealed tier grants a lifetime discount on this range — Copper 20%, Silver 25%, Gold 30%, Relic 40% — together with early access. The discount is the apparel benefit of a pass; passes do not include a free apparel bundle.

**16. Giveback Commitment**
Ytinu Moc commits 25% of its profit to the Unity Vault, a discretionary community treasury dedicated to building and supporting the Ytinu community. It pays nothing out to any individual. This is a binding commitment of the company, not a promotional estimate. Ytinu Passes are not securities and confer no entitlement to profit, revenue, or dividends.
